2008. 6. xx. 김종훈 본부장님, 정운천 장관님 귀하, 한국에서 진행중인 한국인들의 논의에 비추어, 우리는 30개월령 미만의 소에서 생산된 미국산 쇠고기만을 교역하겠다는 한국 수입자와 미국 수출자들의 자율 결의를 환영합니다. 이러한 민간부문의 조치는 한국 소비자들의 미국산 쇠고기에 대한 신뢰가 회복될 때까지 경과조치로 운영될 것입니다. 이러한 자율 결의를 지원하기 위하여, 미 농업부는 농산물유통법에 따라 미국 정부에 의해 관리되는 “한국을 위한 30개월 미만 연령 검증 품질체계평가(QSA) 프로그램"을 도입할 것입니다. 이 프로그램은 모든 미 농업부의 수출검증(EV) 프로그램에 적용되는 품질체계 조건과 운영상 동일할 것입니다. (첨부 참조) 이 프로그램은 본 프로그램에 따라 한국으로 선적되는 모든 쇠고기가 30개월 미만 소에서 유래한다는 것을 보증할 것입니다. 우리는 이러한 민간부문의 조치를 지원하기 위하여, 한국정부 검역관이 경과기간중에 30개월 이상 소에서 생산된 쇠고기가 한국으로 선적된 것을 발견할 경우, 해당 쇠고기 또는 쇠고기 제품을 그 소유주에게 반송시킬 것으로 이해합니다. 미국 정부와 한국 정부는 30개월 미만 소의 뇌, 눈, 머리뼈와 척수가 국제수역사무국(OIE) 지침에 따른 특정위험물질 또는 식품안전 위해가 아니라는데 동의합니다. 그럼에도 불구하고, 양국의 수입자와 수출자는 이러한 품목들은 과거에 교역된 적이 없다고 하였으며, 우리는 동 품목들에 대한 한국내 시장 수요가 있을 때까지 이러한 상업적 관행이 지속될 것으로 예상하고 있습니다. 수입위생조건 제8조에 규정되어 있듯이, 한국 점검단은 한국으로 쇠고기 또는 쇠고기 제품을 수출하는 육류 작업장 중 대표성 있는 표본에 대해 점검을 실시할때 새로이 등재되거나, 이전에 취소되었거나 또는 항구에서의 검사과정에서 해당 제품에 대한 우려가 제기되었던 작업장과 같은 특정 작업장들을 집중적으로 점검할 권리가 있습니다. 따라서 대표성 있는 표본이라는 개념은 한국 점검단이 점검이 필요하다고 판단되는 특정작업장을 점검 대상에 포함시키는 것을 방해하지 않습니다. 한국점검단은 점검 결과 본 수입위생조건에 대한 중대한 위반이라고 판단되는 사항을 발견할 경우, 적절한 개선조치에 대해 즉시 미 식품안전검사국(FSIS) 관계관과 협의할 것입니다. 이러한 기술협의로 문제를 해결하지 못할 경우, 양국 정부는 고위급 협의를 할 것입니다. 양국 정부가 4주 이내에 적절한 개선조치에 대해 합의하지 못할 경우, 해당 작업장의 제품에 대한 수입 검역검사과정에서 식품안전 위해가 발견되지 않았다고 하더라도 한국은 해당 작업장에서 이후 수입되는 다섯 번의 선적분에 대하여 쇠고기 및 쇠고기 제품의 검사비율을 높일 수 있습니다. 수입위생조건 제24조에 규정되어 있듯이, 강화된 검사기간 또는 제24조에 규정되어 있듯이 일반적인 검사에서 2회 이상 식품안전 위해가 발견되면, 한국은 FSIS에 해당 작업장의 중단을 요청할 수 있습니다. 이 요청을 받는 대로 FSIS는 해당 작업장을 중단시킬 것입니다. 한국은 차기 시스템 점검시 해당 작업장을 재점검할 수 있습니다. 우리는 또한 한국정부가 관보에 ‘미국산 쇠고기 및 쇠고기 제품 수입위생조건’을 게재한 것을 환영합니다. 최근 한국 쇠고기 수입자들이 재확인한 바와 같이, 미국산 쇠고기는 안전하며 미국인이 매일 소비하고 있습니다. 우리는 미국산 쇠고기의 안전성과 품질에 대한 한국 소비자 신뢰가 회복되기를 기대합니다. 미 무역대표 수잔 슈왑 미 농업부장관 에드워드 샤프 [미측 서한 영문본] June xx, 2008 The Honorable Jong Hoon Kim Minister for Trade Seoul, Republic of Korea The Honorable Woon Chun Chung Minister for Food, Agriculture, Forestry and Fisheries Gwacheon, Republic of Korea Dear Minister Kim and Minister Chung: In light of the ongoing public discussion in Korea, we welcome the voluntary commitments made by Korean importers and U.S. exporters to trade only U.S. beef from cattle less than 30 months of age. This private-sector initiative will serve as a transitional measure until Korean consumer confidence in U.S. beef improves. To support these voluntary commitments, the U.S. Department of Agriculture is establishing the "Less than 30 Month Age-Verification Quality System Assessment (QSA) Program for Korea" administered by the U.S. government under the Agricultural Marketing Act. This program will be operationally identical to the quality system requirements in place for all USDA Export Verification (EV) Programs. (See attachment.) This program will verify that all beef shipped to Korea under this program is from cattle less than 30 months of age. We understand that in order to support this private sector initiative, if Korean government inspection officials were to find any beef shipped to Korea during the transition period that is from cattle 30 months of age or over, they would return the relevant beef or beef products to their owner. The governments of the United States and Korea agree that brains, eyes, skull, and spinal cord from cattle less than 30 months of age are not specified risk materials under World Organization for Animal Health (OIE) guidelines or food-safety hazards. Importers and exporters in our two countries have nonetheless indicated that those items have not been traded in the past, and, until there is market demand in Korea for such products, our expectation is that such commercial practice will continue. When auditing a representative sample of the meat establishments that export beef or beef products to Korea, as provided for in Article 8 of the Import Health Requirements, Korea’s auditors have the right to focus on certain plants, such as those that are newly listed, had been previously delisted, or whose products have raised concerns during port of entry inspection. Accordingly, the concept of representative sampling does not prevent Korean officials from including in an audit a specific plant that they deem necessary to audit. If as a result of an audit, Korean auditors find what they believe is a serious non-compliance with these Requirements, the Korean auditors will immediately consult with FSIS personnel regarding appropriate corrective action. If these technical level discussions do not resolve the matter, the two governments will consult at a senior level. If the two governments cannot agree with respect to appropriate corrective action within four weeks, Korea may increase the rate of inspection of subsequent beef and beef products from that establishment over the next five shipments notwithstanding the fact that no food-safety hazards have been detected during import quarantine inspection of the products of that establishment. As provided for in Article 24 of the Import Health Requirements, if two or more food safety hazards are detected, both during this period of increased inspection or generally under Article 24, Korea may request FSIS to suspend the relevant establishment. Upon receiving the request, FSIS will suspend the establishment. Korea may also re-audit that facility in its next system audit. We also welcome the Korean government’s publication of the Import Health Requirements for U.S. Beef and Beef Products in its government gazette. As was recently reconfirmed by Korean beef importers, U.S. beef is safe, and it is consumed by Americans every day.
